Legal mediation is a form of negotiation wherein a third party, such as a lawyer or retired judge, assists disputing parties in settling issues related to a business or other type of dispute. The mediator – or third party – who is chosen to perform as the middleman in the negotiations between the disputing parties does not have the authority to make an award or impose a decision upon either side.

Instead, the mediator hears from all sides, reviews the facts of their case, and may point out the weaknesses and strengths of their position in order to bring resolution through legal reasoning. The legal mediation process allows for disputing parties to resolve their arguments by reaching amicable or acceptable solutions. The mediation process does not obligate either side of an argument to accept any proposal of resolution. It merely offers disputing parties the opportunity to reach a mutual resolution.
